These Terms of Use ("Agreement") constitute a legally binding agreement between you ("you", "your" or "user") and GKM IT ("we," "us" or "our"), concerning your access to and use of the Precious mobile application for devices (the "App"). All documents related to the App, including the Privacy Policy and End User License Agreement, are expressly incorporated herein by reference. Please read this Agreement carefully before you download, install, or use the App. By downloading, installing, or using the App, you indicate that you have read, understood, and agreed to this Agreement, which takes effect on the date of download, installation, or use. If you do not agree with any provision of this Agreement, you are not authorized to access, download, install, or use the App.
We reserve the right to make changes or modifications to this Agreement at any time and for any reason. We will notify you about any changes by updating this Agreement. Your continued use of the App after such changes constitutes acceptance of the modified Agreement. We may also notify users of significant changes via email or within the App.
In order to access or use the App, you must be eighteen (18) years of age or older. Users who are minors must have parental or guardian permission and supervision to use the App. Users under the age of thirteen (13) are not permitted to use the App. By accessing or using the App, you represent and warrant that you meet these age requirements and have the legal capacity to enter into this Agreement.
The App is intended for personal, non-commercial use only. Users shall use the App only for its intended purposes. Any unauthorized use of the App or its content is strictly prohibited.
Your use of the App is subject to our Privacy Policy. By using the App, you acknowledge and accept our Privacy Policy. Our Privacy Policy outlines how we collect, use, and protect your personal information. Please read our Privacy Policy carefully to understand how your information is handled.
By using the App, you agree to respect our Intellectual Property Rights. We grant you a limited, non-exclusive license to access and use the App pursuant to this Agreement. This license is personal to you and may not be transferred or sublicensed without our prior written consent.
You agree not to use the App in any unlawful, defamatory, obscene, or infringing manner. You shall not modify, reverse engineer, or distribute the App without authorization. Additionally, you shall not engage in any conduct that could damage, disable, or impair the functionality of the App or interfere with any other party's use of the App.
Access to the App requires a compatible mobile device and internet access. We do not guarantee uninterrupted access to the App or its accuracy. While we strive to maintain the security and reliability of the App, we cannot guarantee that the App will be free from bugs, viruses, or other harmful components. You are responsible for taking appropriate measures to protect your device and data while using the App.
We provide the App "as is" and make no warranties regarding its functionality or suitability for any purpose. We do not warrant that the App will meet your requirements, be uninterrupted, secure, or error-free. You acknowledge that your use of the App is at your own risk and discretion.
We shall not be liable for any damages arising from the use of the App. This includes, but is not limited to, direct, indirect, incidental, consequential, or punitive damages.
You agree to comply with all applicable laws and regulations while using the App. You are solely responsible for ensuring that your use of the App complies with all relevant laws and regulations in your jurisdiction.
This Agreement shall be governed by the laws of India. Any disputes shall be resolved in the courts of India.
We reserve the right to terminate this Agreement at any time for any reason. Upon termination, you must cease all use of the App and delete any copies of the App from your device. Termination of this Agreement will not affect any rights or obligations that have accrued prior to termination.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If any part of this Agreement is deemed unlawful or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
